{"id":263316,"date":"2024-04-03T10:44:34","date_gmt":"2024-04-03T09:44:34","guid":{"rendered":"https:\/\/confecomerc.es\/?p=263316"},"modified":"2024-04-03T10:44:34","modified_gmt":"2024-04-03T09:44:34","slug":"cap-a-la-igualtat-lgtbi-en-el-comerc-avancat-a-les-futures-obligacions-per-a-micropimes-comercials","status":"publish","type":"post","link":"https:\/\/confecomerc.es\/va\/cap-a-la-igualtat-lgtbi-en-el-comerc-avancat-a-les-futures-obligacions-per-a-micropimes-comercials\/","title":{"rendered":"Cap a la igualtat LGTBI en el comer\u00e7: Avan\u00e7a&#8217;t a les futures obligacions per a micropimes comercials"},"content":{"rendered":"<ul>\n<li>\n<h5><strong>Confecomer\u00e7 ha adaptat el seu model de Protocol de Prevenci\u00f3 i Actuaci\u00f3 davant situacions d&#8217;assetjament laboral per a facilitar la transici\u00f3 a les associacions i les empreses i ajudar-los a evitar totes les formes d&#8217;assetjament i\/o viol\u00e8ncia contra les persones.<\/strong><\/h5>\n<\/li>\n<\/ul>\n<p>Les empreses amb m\u00e9s de 50 treballadors han de disposar des del 2 de mar\u00e7 de 2024 d&#8217;un <strong>conjunt de mesures i recursos que permeten garantir i promoure el dret a la igualtat real i efectiva de les persones LGTBI<\/strong>, posant fi a qualsevol forma de discriminaci\u00f3 en l&#8217;\u00e0mbit laboral, tal com establix la <a href=\"https:\/\/www.boe.es\/boe\/dias\/2023\/03\/01\/pdfs\/BOE-A-2023-5366.pdf\">Llei 4\/2023, de 28 de febrer, per a la igualtat real i efectiva de les persones trans i la garantia dels drets de les persones LGTBI.<\/a><\/p>\n<p>Encara que esta llei estableix obligacions espec\u00edfiques principalment per a grans corporacions i entitats p\u00fabliques, el seu esperit i objectius afecten a tot el teixit empresarial, incloses les <strong>micropimes i pimes<\/strong>, que constitueixen el cor de la nostra economia, i no s&#8217;ha de descartar que en un futur no gaire lluny\u00e0 estes exig\u00e8ncies s&#8217;amplien tamb\u00e9 a empreses amb menor grand\u00e0ria.<\/p>\n<p>\u00c9s fonamental comen\u00e7ar a preparar-se i adaptar-se als canvis que promou. Fer-ho no sols \u00e9s una estrat\u00e8gia prudent enfront de futures obligacions legals, sin\u00f3 que tamb\u00e9 \u00e9s una <strong>declaraci\u00f3 de valors<\/strong>, mostrant un <strong>comprom\u00eds ferm amb la creaci\u00f3 d&#8217;entorns laborals respectuosos, inclusius i equitatius<\/strong>.<\/p>\n<h4><strong>Adaptaci\u00f3 del Protocol de Prevenci\u00f3 i Actuaci\u00f3 enfront de l&#8217;Assetjament Laboral<\/strong><\/h4>\n<p>Totes les empreses que compten, almenys, amb 1 persona treballadora estan obligades a disposar de <strong>Protocol de Prevenci\u00f3 i Actuaci\u00f3 enfront de l&#8217;Assetjament Laboral<\/strong>. Este es regula en l&#8217;article 48.1 de la <a href=\"https:\/\/www.boe.es\/buscar\/pdf\/2007\/BOE-A-2007-6115-consolidado.pdf\">Llei org\u00e0nica 3\/2007 per a la igualtat efectiva entre dones i homes\u00a0<\/a>i en l&#8217;article 4 de <a href=\"https:\/\/www.boe.es\/eli\/es\/rdlg\/2015\/10\/23\/2\/dof\/spa\/pdf\">l&#8217;Estatut\u00a0 dels Treballadors<\/a>. A m\u00e9s, \u00e9s una de les mat\u00e8ries que ha d&#8217;incloure obligat\u00f2riament el\u00a0<strong>Pla d&#8217;Igualtat.<\/strong><\/p>\n<p><strong>Mancar de Protocol es considera una Infracci\u00f3 Molt Greu<\/strong>\u00a0i est\u00e0 regulada en els apartats 12, 13 i 13 bis de l&#8217;article 8 de la\u00a0<a href=\"https:\/\/www.boe.es\/buscar\/pdf\/2000\/BOE-A-2000-15060-consolidado.pdf\">Llei sobre Infraccions i Sancions en l&#8217;Orde Social (LLISOS)<\/a>.\u00a0Les sancions administratives poden anar des dels 6.251 euros fins als 187.515 euros.<\/p>\n<p><strong>Una bona manera d&#8217;avan\u00e7ar cap a la igualtat LGTBI en les empreses m\u00e9s xicotetes \u00e9s adaptar els seus Protocols d&#8217;Assetjament, incloent:<\/strong><\/p>\n<ul>\n<li><strong>Declaraci\u00f3 de principis<\/strong>: el comprom\u00eds de l&#8217;empresa amb la inclusi\u00f3 i el respecte, abastant de manera espec\u00edfica a les persones LGTBI.<\/li>\n<li><strong>Dec\u00e0leg de bones pr\u00e0ctiques<\/strong>: normes clares de comportament i respecte mutu.<\/li>\n<li><strong>Glossari i diferenciaci\u00f3 conceptual<\/strong>: aclariment i fixaci\u00f3 de termes i conceptes per a evitar malentesos i fomentar el respecte.<\/li>\n<li><strong>Procediment de den\u00fancia<\/strong>: establiment d&#8217;un m\u00e8tode clar i confidencial per a reportar incidents.<\/li>\n<li><strong>Accions sancionadores<\/strong>: definici\u00f3 de les sancions previstes per a dissuadir possibles comportaments poc \u00e8tics o situacions discriminat\u00f2ries.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>Confecomer\u00e7 ha adaptat el seu model de Protocol de Prevenci\u00f3 i Actuaci\u00f3 davant situacions d&#8217;assetjament laboral per a facilitar la transici\u00f3 a les associacions i les empreses i ajudar-los a evitar totes les formes d&#8217;assetjament i\/o viol\u00e8ncia contra les persones.<\/strong><\/p>\n<p>Tant el <strong>model actualitzat de Protocol<\/strong>, com la resta dels elements del pack de <strong>Confecomer\u00e7 (diagrama de procediment d&#8217;actuaci\u00f3, plantilles de compromisos i models de den\u00fancia i informes d&#8217;investigaci\u00f3), aix\u00ed com un\u00a0seminari web explicatiu i v\u00eddeos<\/strong>\u00a0en els quals s&#8217;exemplifiquen algunes situacions de possible assetjament, es poden trobar en <a href=\"https:\/\/formacion.confecomerc.es\">l&#8217;Acad\u00e8mia dels Comer\u00e7os Pedro Reig Mar\u00ed<\/a>.<\/p>\n<h4><strong>La import\u00e0ncia d&#8217;avan\u00e7ar cap a la igualtat LGTBI<\/strong><\/h4>\n<p>Encara que les\u00a0<span class=\"hiddenSpellError\">micropimes<\/span>\u00a0i pimes encara no estiguen obligades a complir amb totes les disposicions de la Llei 4\/2023, de 28 de febrer, \u00e9s crucial fomentar un ambient de treball inclusiu i respectu\u00f3s. La formaci\u00f3 en diversitat i inclusi\u00f3 pot ajudar a previndre la discriminaci\u00f3 i millorar el benestar de tota la plantilla.<\/p>\n<p>A m\u00e9s, desenvolupar plans i implementar pol\u00edtiques internes que promoguen la igualtat i la no discriminaci\u00f3 en les petites empreses pot resultar molt benefici\u00f3s.
